Records Management Legislation in North Carolina

As a state agency, East Carolina University is subject to state and federal legislation concerning records management. NC General Statute 121 – The North Carolina Archives and History Act outlines the authority of the North Carolina State Archives to direct records management programs in all state agencies. NC General Statue 132 – The North Carolina Public Records Law defines public records, access to them, their custodial instructions, and approved methods of destruction.

On the federal level, The Family Educational Rights and Privacy Act of 1974 (FERPA) protects the privacy of student education records. This law applies to all schools that receive federal funds under an applicable US Department of Education program. The Health Insurance Portability and Accountability Act of 1996 (HIPAA) protects the confidentiality of personal health information.
