Non-Academic Conduct Process
Any member of the East Carolina University community may file a complaint against any student for misconduct. The complaint must be prepared in writing and directed to the Office of Student Rights and Responsibilities (OSRR).
Any student who has a complaint filed against them for an alleged violation of the Student Code of Conduct is referred to as the accused student. The person who has filed a complaint is referred to as the complaining witness.
Upon receiving the complaint, OSRR or the Student Attorney General (AG) may conduct an investigation to determine if it is possible a violation of the Student Code of Conduct has occurred. If a member of the OSSR staff or the AG believes it is possible that a violation took place, the accused student will be asked to meet with him/her. During this meeting the OSRR staff member or AG will try to determine if there is enough information to support a finding that the student violated the Student Code of Conduct. If all parties agree a policy violation did not occur the student will be found not responsible and the case will be closed. If all parties are able to agree a violation has occurred, appropriate sanctions will be discussed. A student can request a hearing before the Honor Board if they are unable to settle the case with OSRR or AG either because they disagree that a violation occurred, or believe the sanctions outlined were not appropriate for the violation. The Honor Board hears complaints involving alleged violations of the Student Code of Conduct.
In preparation for the hearing the AG and Advocate for Accused Student (Advocate) will select the members of the Honor Board and gather information on behalf of the University and accused student to be presented in the hearing. The Advocate will explain the process to the accused student and address any concerns or questions.
